It's not that way, is it? If you're held in jail, it seems like someone has already made that decision. Guilt has to be proven beyond a reasonable doubt.
The view that everyone should go to prison stems from the belief that people think they can do whatever they want to others. When someone says, "You can't make me do that," the reality is that others can and will enforce their will.
