Screwed Again by Child Support.
 
A little History
The original order for Child support was written in Jan 2012, and like most people, I was in arrears from the start because, again, like most people, I wasn't paying from the day that my kids' mother filed, which is the law. Granted, you don't know the amount you'll have to pay or even that the custodial parent has filed, in most cases, which is why so many people wait until the order is set.
 
So from day 1, I was $5600 bucks in arrears, with the standard 9% interest kicking in and prorated back to the date she filed. An additional $25 per week was added to go towards arrears, which is really going to the interest.
 
In 2012 I didn't get a tax return because I was self employed. In 2013, I didn't file, because I was lame and in 2014 I filed for both years - and paid the late penalty for 2013. Any remaining refund money went right to my kids' mother - about $5,000. Yes, I get nice returns.
 
In Sept of 2015, I got a letter from Child Support, like everyone that's behind gets when they owe back Child Support, saying I still owed $4600.00 - which they took in 2016. In May of 2106, I called the local office and asked to confirm I was no longer in arrears, and was told the balance was $0.
 
An Education on How Illinois Screws Us
September of 2017, I get a letter from Child Support claiming I'm $1000.00 in arrears, so I respond, asking for a full account review. Mind you, the extra $25 a week is still being added to my Child Support all this time, except now, for some unknown reason, they take the extra for a month, then drop it for a month, then take it for a month, and so on, and so on.
 
1st week of October, I go to a job here in Pekin and whaddayaknow, the Customer is the Head of the Peoria Child Support office. SO I tell her this story and she says to me, "You must get paid bi-weekly!" Which, I do. Follow this, bi-weekly means every 14 days, not twice a month.
 
She proceeds to tell me that people who get paid bi-weekly and pay Child Support are getting screwed by the state. The computer is designed to recognize weekly payments and twice a month payments - on the 1st and the 16th.
 
Follow me now. If the 1st is on a Tuesday, and you get paid on Friday - you're in arrears. Boom, the 9% juice kicks in. The payment that comes out on that Friday doesn't get you out of arrears. Next Check is in 2 weeks on Friday, but wait, the 16th was on Thursday. You're in arrears!!
 
The state knows about this glitch, but they refuse to fix it, and why would they?? They keep that interest money. The custodial parent only gets the principle amount.
 
Well, I never did get my review, but in 2018, they also didn't hit my account for an extra $1000.00.
 
Today
Here were are, in September again and guess what I got today?? You got it, a letter from Child Support, telling me I owe $746.00 in back Support!!
 
These bastards are getting away with a crime, in my opinion and anyone in the same boat is getting the shaft the same way - although most people probably never even take the time to research why they can't ever seem to get caught up on their arrearage

I think I would be quick to contact your state Representative and Senator. These are problems that they should be aware of and make an effort to get the ball rolling on a correction.

Yup. This is exactly the type of stuff your local representative should be working on.
 
I would ask that all the interest that you have paid over the years be put into an education fund for your children. There is absolutely no reason for the state to keep that money from families.

Can't speak for the state but it has to be similar to the federal government and that is that the government agencies DO NOT like it when a constituent has to turn to a representative or senator to take care or resolve a matter. It means they have an elected official breathing down their back and the agencies don't like it, so they cooperate.
The contacts they use are way up the chain of command and things will be worked out. Sounds like you have detailed notes which greatly, greatly helps too.

It's bullcrap ! When I was paying child support , my employer would take the money out of my check and send it to Chicago, Chicago would send it to Springfield and Springfield would send it back to Chicago which then would send it to my ex in oak lawn , which they said put me behind 3 months , After taking the case to court and proving the goose chase , the judge ordered in my favor dismissing it and all back debt ...

I am a guy and was divorced in 1990. I ended up with custody of my two kids. She paid me child support. Here's my belief on child support.
First of all, be nice. They are your kids. I believe the person getting paid needs to keep record as to where that money is being spent. I did. Nobody wants to pay for their ex's booze and cigarettes. Nobody ever asked me where the money went that I received and that is one of the main reasons a person does not want to pay. Know for a fact that you are going to pay if you don't have full custody and be prepared for it. I think I remember for my two kids it was 25 percent of her income. Be ready to pay. Be nice to the ex. Your kids will thank you later.

I've rarely ever met a man..that was paying child support..not complain about it...no matter how it was paid out..I was lucky..my ex got paid weekly and handed over 50% of his check over to his daughter in court ordered child support....never complained once..he did get testy when I offered to split college for her 50/50..he said she was 18 and he was done..so I took him back to court..he ended up paying 70%....should have took me up on my offer

When I was divorced I paid child support, maintenance, and 20% of my overtime(I worked a lot of overtime but only at certain times). Since each payment was figured based on base pay and overtime, I wrote a check twice a month 1st and 15. They were always different amounts. I kept a running account of each payment plus all the medical and dental bills which were not considered support ( paid at 100%). Three years into the divorce I get a subpoena to appear in court for arrears. I had a $36,000 claim against me. I thought it was a mistake. Nope, her attorney sued saying I never made any child support payments since they were no dispersed through the state program, but that's what we agreed to. $4000.00 in attorneys fees later I settled for $3500, because I had kept such meticulous records. So, $7500 was paid for trying to do the right thing.
My advice go through the State dispersement.

Are you saying I'm wrong?? That I should let the state screw me over??
 
Between 28% for child support and covering my kids' insurance, I'm giving up approx 40% of my check and every dime, my kids' mother brags about spending it on herself, which means I also pay for school supplies, lunches, winter boots, yearbooks, etc.
