@ChefKevin: Sam Adams' newest beer is illegal in 15 states. This beer isn't just scary levels of alcoholic, it's actually illegal in several states.
Samuel Adams is bringing its Utopias beer back just in time for Halloween, but not everyone will be able to find the brew. Due to the drink's high level of alcohol, it's actually illegal in 15 states.
According to Forbes, Sam Adams' only brewed 77 wooden casks of Utopias, which the outlet describes as having "distinct vanilla notes and subtle nutty and elegant dark fruit aromas." The beer also claims to have an ABV (alcohol by volume) of 28 percent, significantly higher than the average beer (which is usually lower than 10 percent).
A spokesperson for Samuel Adams confirmed that due to its high level of alcohol, this already hard-to-find beer is illegal in 15 states. This includes Alabama, Arkansas, Georgia, Idaho, Missouri, Mississippi, Montana, New Hampshire, North Carolina, Oklahoma, Oregon, South Carolina, Utah, Vermont and West Virginia.

Are hard liquors illegal in these states? Most of them are at least 40%.

One other thought. This may give DUI drives the ability to claim "officer I only had two beers," and be telling the truth.

@skutfarcus : Alabama - We get to start off with one of the best ones. Beer and wine are not controled by the state, but spirits are. On and off-premise liquor sales are limited to 2 A.M on Sundays. Beer and wine can be sold in supermarkets but spirits can not. As stated above alcohol can be served 24hrs unless restricted by local ordinances, 26 of Alabamas 67 counties allow no alcholol to be sold, though posession and consumption remains legal. Here comes the best part: there is a 6% ABV cap on beer sales, bottles can also not exceede 16oz. Wine also faces a 14.9% ABV limit. So Jimmy can get wasted on some 40% ABV Jack but cant get a good beer if it happens to excede 6% ABV…such wise laws. Homebrewing is also currently illegal in Alabama, though the fine homebrewers of that state are working to ammend this.
Georgia - Has some interesting laws. Sales are not controlled by the state. Hours of sale are determined by County. Beer with ABV above 14% is illegal. No Sunday off-premise sales. Certain areas public consumption is legal but has the following limitations: One drink on street, size no more than 16 oz, drinking from a can, bottle or glass is prohibited. Pretty damn prohibitive to do something that is on the books as legal…
There are some very strange state alcohol laws.

@bwiser : Oh yeah. We spent a Sunday night in Northern Alabama a few years ago. We went to a Logan's Roadhouse next door to our hotel. I asked for a beer. They wouldn't even let me have an O'Doul's. Our server, 'Brittany' (That's my truck right out there) offered to take us to the next county when she got off, but we declined. A few years before that, I stopped at a gas station in GA on a Sunday afternoon and found chains and padlocks on the beer cooler. I could tell you a very frightening story about KY in the early 70s when my hair was shoulder length. But it would take a while, and you would have to buy the beer.

Should I be surprised that Illinois is not one of the states banning this new Samuel Adams beer?

The utopia is something like $200+ for sonething like a 24 oz bottle. And hard to find. Not exactly a mainstream thing.

And the 2016 I had a small glass of was excellent.

@DennisinMH : Why? I'm sure they would love to tax it.

I had the opportunity to buy a bottle a few years back but passed because of the price tag on the secondary market. For 3 years in the mid-late 90s SA made a beer called Triple Bock in a 7 ounce bottle. It had no bubbles. You couldn't drink much of it. It was like a very dense Porter/Imperial Stout blend that tasted cognac based (though I don't think it was).
