I don't know. They nabbed BWW, and there are no walls whatsoever in their outdoor patio. There's a roof and that's it. So now what constitutes outside?

Pretty ****ing soon the parking lot will be considered inside.

Don't forget the smokers have to be 15 feet from the entrance so if the BWW smokers were directly outside the door, even at a table, that would be a violation. You don't have to agree with laws to follow them, I hated it when they made seatbelts a law but now it's such a habit, I do it to go 3 blocks. Smokers have to get into the habit of following the law even if it seems stupid because the cops have a special grant that pays them to do these checks. They can't transfer this grant money into busting real criminals so they might as well use it for what it's for.

Out here in NYC, you can barely smoke anywhere. Mayor Bloomberg, who used to smoke 2 packs a day, is not an anti smoke Nazi.

They outlawed smoking on beaches and in city parks, as well as pedestrian walkways (read: Times Square). I have meetings once a week just outside of Central Park. We take an hour break for lunch...it was so relaxing for me to go to Central Park, sit by myself on a bench over looking a pond, and smoke a cigar.

I still do it, even with the law, and nobody has ever said anything to me. They also wrote exemptions into their smoking ban for several cigar bars, so there are places where you can go to get a drink, and smoke cigars, but the places often ban smoking cigarettes in them, which is A-OK by me.

Speaking of insurance, should the business owner be liable for health issues related to subjecting patrons and employees to these cancer causing emissions? This isn't unprecedented, as employers are typically liable for willingly subjecting employees to hazards. especially when the risk is easily reduced, by not allowing smoking inside! Of course, proving that a certain establishment was responsible would be extremely hard for the patron, I assume it would be easier for the employee.

And it isn't just about profits, private business, etc. Those that have done the right thing, and banned smoking on their own prior to the ban, have inconsiderate ****s that smoke right outside the door, if we want to talk about anyone ****ing off, it should be them.

If the ban was to be lifted, than assault needs to be legalized.

There were always smokers standing outside the building where I used to work. And they would stand so close to the door that the smoke would waft in whenever anyone opened the door. And there would be so much smoke that it would set the fire alarm off.

One of the smoke detectors was fairly close to the door. Eventually they had to move the smoke detector further away from the door because it was going off so frequently.

What a joke. Having to move a life safety device due to the carelessness of a smoker.

I'm not fan of an overreaching government anymore than the next guy, but one must note the only reason this ban came into effect anyway was because of inconsiderate people. If people acted responsibly there wouldn't be any issue, and probably wouldn't be a ban.

Why "should the business owner be liable for health issues related to subjecting patrons and employees to these cancer causing emissions"? No one is forcing patrons to frequent the business nor employees to work there. If you don't like smoke, why would you go there or work there in the first place? That is the reason I quit bar tending and went back into the kitchen...I was tired of inhaling the stuff and smelling like an ashtray!!
