We'll agree there.. There wouldn't be a problem, and probably wouldn't be a ban. Unfortunately, meanjarhead, from my experience considerate smokers are in the minority.

This is true, smokers could stand to be a bit more courteous, as a whole. Some of them are honestly just oblivious to where their smoke is blowing (my wife, unfortunately).

But as a smoker myself, if you walk by me on the sidewalk or street and faux cough to show me your discontent with my smoking habit, I'm going to laugh at you.

So, what you are basically saying is that it is OK to harm someone so long as they consent to it?



No. I'm basically saying that you are responsible for your choices. If you are concerned about the health risks of second-hand smoke and you deliberately put yourself in an atmosphere of second-hand smoke, it's not the restaurant owner's or smoker's fault that you put yourself in that position. It's your fault.

Here's an analogy: Suppose you are mildly allergic to peanuts. You know that Logan's Steakhouse is one of those places that has buckets of peanuts on the tables and shells on the floor. Yet you go there anyway, knowing full well you may have an allergic reaction in that atmosphere. Is Logan's harming you? No. You're putting yourself in harm's way. There's a difference.

Life is full of risks. We all make choices.

only thing i have against smokers is watching them flick the smoke out the window of their car. empty their ashtrays in parking lots. watching them flick the cig in their yard. the one that ticks me off the most is when they flick the smoke in my yard. or standing in my yard and flick it in the street.

yes i smoke if i am in public i don't smoke. the minute i get in my car thats a different story.

Does that logic apply to other harmful acts committed against people? Say, if you or I strolled into an area known to have a high homicide rate, if I got shot, my fault for being in that area?

I'd agree with you, CJ.. if the actions being defended weren't a public safety issue. I still believe strongly, your rights as a business owner or a smoker go only so far, and stop when you are putting others at risk. Willingly harming someone, rather or not they are aware of it, and consent is still wrong. Didn't they throw Kevorkian in jail for that? lol

The point of this is, what is inside and what is outside?

In the example of Kouri's, they purpose built an outdoor patio area with, WHAT THEY BELIEVE WAS, enough open area in the walls to be considered outside, per the law. So who's right and who's wrong? I guess ultimately the courts will decide.

The big problem is there are about 50 other things the peoria police dept should have been doing instead of busting smokers.

First and foremost, PPD is about making revenue. Catching gang bangers doesn't make money!
