photography isn't art. A photographer is just capturing an image with technology, they aren't creating anything.

@Pock:

I know some photographers who would disagree with you.

@AverageJoe:

I'm married to one of them. There is a lot more too it than showing up with a disposable camera from Walgreens. If you don't believe it, ask wedding photographers why they have to carry insurance. People sue when the "capture" is not just right. Almost as if it's an art or something.

@AV8R:

Frogy has taken pictures for me several times and I was thrilled with the results. She has a talent and even if I stood next to her and snapped the same object at the same time my picture would not be as nice as hers.

@leslie110:

I have stood next to her and snapped the same object and mine didn't come close - and I don't consider myself a lackey either.

It is truly an art, and if you don't know that, then you're not there yet, photographically speaking.

@AV8R:
That was my point, AV8R. and I've been to MoMA where there's plenty of camera shots... Pock might not consider it art (I presume, by what he wrote), but plenty of people do.

"art" is entirely subjective. yes, anyone with an SLR can call themselves a pro, because all anyone cares about is that you take pretty pictures. deal with it.

Owning a fancy camera doesn't make you a good photographer, and the fact is, most people don't even know how to use them.

the camera doesn't make the picture, I agree, but if you can take a steady well-lit image, then you can get paid money for it.

certainly there is an artistic side of it, but again, entirely subjective.

Beauty does not equal art, While the images are creative, I'd argue they are rarely original.

Put me next to any photographer with the same equipment and angle and I'll take the same picture. Put a paint brush in my hand, and sit me next to a Da Vinci painting and I'd have no chance of replicating his original work.

@Pock:

Shouldn't it be up to you to figure out the equipment and angle? That is where the art part comes in...

@tapeworm:

That was my point. The creation of a photo is strictly a mechanical process, at the critical moment of creation there is no art, no person, just technology. Capturing the world as it is in that moment. There is no doubt people should be paid for their equipment and time, but they haven't created anything. It isn't theirs.

@diezelmom303:

A simple Answer. Yes. It is a rip-off. A misuse of copyright law. Unfortunately.

I could pose the kids like froggy did here but I wouldn't know what angle and/or lighting to use...and I wouldn't have had the lighting person that she had.

*I have a release to use these pictures as I wish, reprint as I wish, and post as I wish. I wouldn't do it otherwise.

@AverageJoe:

That was pretty much established at the beginning, the thread is rather or not that is a ripoff.

@Pock:

It was my understanding, @Pock, that you were saying they shouldn't "own" it. This is the quote that threw me off:

If a photographer can claim a "copyright" by using technology to capture an image, than in the same right, the manufacture of the camera could.

That bit doesn't really address whether or not it's a rip-off, IMO. Your analogy seems like praising the farmer who raised the cow you ate at an upscale restaurant when you had the filet mignon.

anyway, I don't think it's necessarily a rip-off. Perhaps overpriced, but not a rip-off.
