What exactly is the problem with getting a FOID? I guess I understand it's a bit of a hassle, but is there some tin-foil bull**** that I didn't get the memo on?

the problem is that I refuse to allow the state of Illinois to sell me my constitutionally guaranteed right as if it is a privilege. I am also not sold on the idea of doing time in IDOC for no other reason than this state wipes its ass with the Constitution.

I'm not glossing over anything. "Well regulatedz' is immediately followed by "militia."
The Supreme Court ruled in District of Columbia v. Heller "The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home." Two years later, in McDonald v. Chicago, the Supreme Court applied the Heller ruling, in essence the individual RIGHT to keep and bear arms. to the states via the 14th Amendment. Bottom line, I have a constitutionally guaranteed INDIVIDUAL RIGHT to keep and bear arms guaranteed to me by the United States Constitution, and applicable to the states through the 14th Amendment. So tell me again Sterling, how is it OK for the state of Illinois to force me, under threat of incarceration, to have to register that right with them prior to exercising it, and then to charge me money to do so? To add insult to injury, the RIGHT that I have to register with the state has an expiration date! What's next, @sterling? Pony up a few dollars to register your right to be free from unreasonable search and seizure? How about due process? "Oh, I'm sorry sir, we don't need a search warrant to search your house, I see here you have not registered with the state so you don't enjoy that right!" Would you be on here supporting that as well? And before you claim I'm some seperatist nutjob, I don't mind paying vehicle registration fees or driver license fees, I don't even mind being required to register my federal pilots license with the state prior to exercising the privileges of an airman in this state...because those are all PRIVILEGES. I don't have a Constitutionally protected right to drive, or to fly. I am granted those privileges by the state, and/or the federal government. No beef there. Not so with firearms. That is a RIGHT. What happens at the intersection of your right to bear arms and my right to safety and security from people not as responsible as you with their firearms? How do we even determine who those people are? Do your rights trump mine? Do mine trump yours? Who makes that call?

How many of the Bill of Rights amendments are supported, directly or indirectly, through fees or taxation?
The vast majority are based on enforcement of associated supporting laws, which of course is performed by public servants paid for by taxes. Think about it; You are paying taxes to house soldiers who would otherwise be shacking up in your basement if it wasn't for that glorious 3rd amendment, for free, no less! But, I can understand how paying $10 for a FOID card every 10 years is quite an onerous and oppressive requirement. Particularly when one considers that it probably costs the state quite a bit more than that to perform background checks and maintain databases of ineligible felons, domestic abusers and restraining order subjects. |
