Supreme Court on Left Coast upholds gay marriage...

I for one am surprised at this ruling. Iowa is now officially more progressive than California!

I am so sad for those in California who want to get married and can't. I can't imagine being gay, finding the love of my life, and being forced to live as second class citizens, what a sad day!

Think back to when women couldn't vote, nad had limited rights.
Or blacks eating out of the backs or restaurants, etc....

Same philosophy

It would be interesting to know; why they decided to uphold such a ban. Was it simply just cause voters had approved it? Anyone know?

Under California law there is no material difference between marriage and domestic partnership... so for this state the infringement on rights was a bit hard to prove.

The ruling as the case was presented to the court was more about the legal formalities between a limited constitutional amendment or a wholesale constitutional revision that requires a two thirds vote of the Legislature to be place before voters.

from the decision:
First, as explained in the Marriage Cases, supra, 43 Cal.4th at page 780, our task in the present proceeding is not to determine whether the provision at issue is wise or sound as a matter of policy or whether we, as individuals, believe it should be a part of the California Constitution. Regardless of our views as individuals on this question of policy, we recognize as judges and as a court our responsibility to confine our consideration to a determination of the constitutional validity and legal effect of the measure in question. It bears emphasis in this regard that our role is limited to interpreting and applying the principles and rules embodied in the California Constitution, setting aside our own personal beliefs and values.

hows come u are raised to treat everyone equal but when gays want full rights like others they are treated badly ? makes no sense to me . u cant call a black a bad name and get away with it . treat them like slaves and all . every one is equal .

I just think it is funny that if California's want to get married the have to take a trip to Iowa.
I wonder if the fact that California is full of Hispanics and most are Catholic have anything to do with the vote?

Probably right about the Hispanic vote Todd.

Also the LDS (Mormon) backed 501c3 groups spent literally millions of dollars in advertising for Prop 8 in California.

We have some friends that are nudist. Why aren't they allowed to sit in their front yards without clothes on? Why can't they ride the bus or go to a movie in the nude? Their bodies belong to them and they aren't hurting anyone by not wearing clothes. What right do we have to tell them what they can do?
Why are we denying them their rights?

Why???? Because our laws are supposed to be based on what the majority of the people believe is right or wrong. Not on what the minority wants or believes.
The majority of the people in this country think homosexuality is a form of perversion and that it's wrong.

Once A majority of people once thought blacks shouldn't vote; go to school or be in the same building as a white... Once a majority of people thought Women shouldn't vote.. A US President was actually quoted as saying "NO Decent Women would ever want to vote"

Once a majority of people thought the world was flat.

You're probably right and sooner or later most everything we now consider wrong will one day be right. But, until that time comes homosexuals, nudist, murderers and rapist are just going to have to suck it up.
